Mr Allen Hepburn, a resident of the Klipeiland Agricultural Holdings near Bronkhorstpruit, was brutally murdered at his house on Sunday morning while changig a flat tyre on his vehicle in front of his house.

David Hall, unarmed Potchefstroom dairy farmer, 49, shot dead execution-style, wife Bernadette, 44 hit over head, survives Feb 20 2012 Potchefstroom, Buffelshoek, farm Frischgewaagd: BUFFELSHOEK- 49-year-old dairy farmer David Hall was murdered at about 06:00 Monday 2012-02-20, on his farm Frischgewaagd, Buffelshoek. close to Potchefstroom.

Above: The farmer and his 45-year old wife were milking cows in their dairy, which is situated 70m from their house, when they were overpowered by approximately 5 unknown armed black male suspects. (according to the wife’s description, she gave in radio interview later today). They were both taken back to the farmhouse, the farmer was shot from behind in the head and he passed away on the scene, between the farmhouse and dairy. His wife was taken inside the house and tied up. She was assaulted by the suspects striking over her head with a blunt object. The suspects fled the scene in a Nissan Almera, belonging to the farmer with registration number: FMC 425 NW. The vehicle was found abandoned outside town. A family friend who happened by to visit the farmer and his wife managed to untie the wife and informed neighboring farmers of the incident. The Police were then informed of the attack. The 45-year old wife was taken to hospital for medical treatment. .A SAPS spokeswoman for North West Adele Myburgh was the first official to confirm that the farmer’s wife also was injured. — “OFM-Nuus” radio was reportedly told that a neighbouring farmer had rushed the injured Afrikaans wife to hospital. Leonard Hlathi. The gardener rushed next door to get help when he saw the garage and kitchen-door were broken open. Wakkerstroom’s ex-mayor Chris Smit said the neighbour found the murdered Mrs Niebuhr ‘in a pool of blood’. She was stabbed fiercely: knifing wounds were visible in her neck, face and back. Nothing appears stolen: her VW Polo was used as a getaway car and found abandoned near Volksrust. journalist Marietie Louw-Carstens of Beeld newspaper reports that the Limpopo farmer, 38, was shot and then his wife Eunice and their two small children were tied up. He was a nutrition-expert at Alzu Fees in Middelburg, Mpumalanga. Mrs Du Toit and the children Francois (12) and daughter Stephanie (9 were dragged outside to a lapa at the homestead where they were left trussed up like pigs with their hands and feet together.

 Mrs du Toit managed to cut her bonds after the murderers drove off in the family cars – which they abandoned on the farm shortly thereafter. She called the neighbours on their twoway radio. Mr Du Toit was still alive when the neighbouring farmers who rushed to their aid, tried to get him to a hospital but he died in their arms. His friends and neighbours said Mr Du Toit was a natural leader in his community and was well-known to the members of the Milk Producers Association.

Afrikaans students in Stellenbosch again assaulted by aggressive SAPS: father Hans Wessels lodging charges: Feb 20 2012 – Adriaan Snyman of Eblockwatch writes: Police have once again been accused of violent behaviour towards students and sociable young people in Stellenbosch. Two students who live in a flat near the Terrace pub in Alexander Street said they heard there was “trouble” in the early hours of Saturday morning and saw how about 15 police vans and other security vehicles “swarmed” over the parking area next to the Anglican Church on the Braak, across from the pub. Francois Lötter and SP von Schlicht took cellphone videos of the incident. “There was a fight between two guys from different racial groups after one guy shouted out a slur. Someone called over an ADT vehicle and suddenly it was just sirens and police wherever you looked. About five or six guys were arrested and thrown in police vans, even if they just wanted to explain what had happened. The brutality with wh ich police handled the people was unnecessary.” His flatmate, Von Schlicht, agreed: “It didn’t matter if you were a guy or a girl, everyone in the area was sprayed with pepper spray. Their eyes looked bad.” The video recording showed how one student was grabbed on his ankle and belt, dragged across the ground and was thrown hard against a police van twice. Similar incidents were reported a while back, including a raid four years ago that made headlines. Hans Wessels from Somerset West is lodging a civil case against the minister of police after his children suffered at the hands of the police last year. “It looks like there is no order and authority in the senior ranks of Stellenbosch police. They are charged and subpoenaed, but the same thing happens again and again.  “The place where they [students] should be protected, they fear, because polic e act like hooligans. A child in Stellenbosch should be able to seek refuge with law enforcers, but here it isn’t the case,” said Wessels. Lieutenant Colonel André Traut confirmed that “seven men between 19 and 21 years old were arrested for disorderly conduct between 00:40 and 01:15 on Saturday. Black SAPS member arrested for shooting dead Asian-SA Rean Ramdin in Boksburg nightclub  reported by EWN Jacob Moshokoa – A police officer was arrested by the Germiston flying squad for alleged police brutality at a Boksburg nightclub in which Asian-South African man Rean Ramdin (29) was shot dead.Mr Ramdin was allegedly rounded up with other club-patrons for ‘alleged drugs possession’ and tried to flee when he was shot dead.The Independent Complaints Directorate (ICD)’s spokesman Moses Dlamini confirmed that the police officer was arrested by the Germiston flying squad. The ICD also announced that ‘the results from Ramdin’s post-mortem will not be released’ but that they ‘could assure the family that the perpetrator would be brought to book. The sergeant was expected to appear in the Boksburg Magistrate’s Court tomorrow, Wednesday.

January 24 2012 SA Pres Jacob Zuma has come under fire for flouting constitutional requirements over the deployment of the military in civilian areas.Letters sent by the Presidency to Speaker Max Sisulu informing Parliament about three major deployments last year authorised by Zuma showed that they were sent between three and six weeks after their respective deployments had commenced.

The constitution requires that only the president can authorise the deployment of the military, and also that Parliament must be informed “promptly and in appropriate detail” by the president about the deployment. Opposition Party Democratic Alliance wrote to Sisulu requesting him to act against Zuma for “repeated failure to respect Parliament’s standing in relation to defence force deployments”. DA MP David Maynier said letters from Zuma tabled in Parliament yesterday showed how constitutional provisions were violated during the deployments as Zuma “failed to inform Parliament about the details of deployments”.  The three deployments of the SA National Defence Force occurred in 2011: Over the festive season, in co-operation with the SAPS between November 1, 2011 until January 1, 2012; During COP17, with the SAPS, from November 21 to December 11 last year. Thakeng said the second attack occurred when the 27-year-old husband of a 22-year-old woman was beaten with steel pipes when he tried to flee with his wife. The couple had been homeless and had temporarily stayed with the man’s brother but were asked to leave the house: and the couple then moved into their car, parking it behind a supermarket in Sandania suburb near the old disused Pres Brand goldmine. A black man claiming he was a security official tapped on the window of their car and told them they were not allowed to be there. However before they could flee, two more black males showed up, bashing in the car-window with bricks, and beating the husband in the face while he was trying frantically to drive away. The man’s face was injured by the glass – and when the old car ‘s engine failed and he tried to push the car with his wife steering, the terrified couple were attacked. Three men raped the woman. Background:
Kanoneiland is one of the largest inhabited inland islands in South Africa measuring 14 km long and 3 km wide. 1 374 hectares of the 2 553 hectares of the fertile land is intensively cultivated and under irrigation.
According to records the settlement gets its name from a battle which took place between the local Koranna tribe and farmers who landed there in 1928 and decided to settle permanently. Upon crossing the Orange River in a small corrugated iron boat they took with them the famed canon, said to have played a major role in the consequent battle and which is now on display at the Kanoneiland primary school.

South Africa – “I thought I was too of macho man to shed a tear, but yesterday, during my bed time prayer,I lost it. I actually growled with tears flooding down my cheeks. I still can’t get my head around it: Women and girls raped as a form of protest, so I was told.
    I started hearing this kind of stories when I arrived at one of the fiery blockades in Bapong where some of Bapo Ba Mogale Unemployed blocked a road. There, one of the ladies who were collecting money from cars that needed to go past their blockade, said that a white woman was dragged out of her car and raped somewher close to a bridge next to shaft2 of Lonmin Platinum mines. Something in her voice said she was glad about it. I tried not to let my emotions cloud my reasons for being there.
     Having deeper knowledge of the plight of this community, I explained that the protest was fruitless since what we want is with us at the moment. What the protesters want is for government to come to Bapong and listen to our plight. The NW government has been in this Bapong community for more than a month now, but it seemed like it was the first time they heard of it when I told them.
    The protests of Bapo Ba Mogale Unemployment Forum were sparked by Lonmin’s disregard of its agreement with local community regarding employment and procurement. Almost 98% of Lonmin employees are not local residents. In the recent past, Lonmin was not fazed to bring a bus full of prospective employees from Eastern Cape while locals were denied opportunities. Contract in the mine are also given to people outside of this community.
    There are talks going around that Lonmin deliberately denies locals opportunities because of its own generalised misconceptions. For an example it is said that Bapo community cannot last three months in employment. Lonmin seems to ignore the fact that it was its duty to train local on jobs that are appropriate.
     For an example, with dedication, all management jobs could have been occupied by locals. Local people are more educated to work at the same level as a miner, for an example.
    I state the above to show that protest were genuine in this regard, only if there was no response from government. The uneployment forum had two protest in the past, which they called round one and round two respectively. The current protest, called round three was proposed in 2011 when Lonmin failed to employ the number that they promised to employ.
     Another aspect of the strike is lack of effective communication from Lonmin. First they told representatives of Bapo that the gave Bapo 500Million, during December they said the’y employ about 2500 people before Christmas and there are many who say the saw reports on Beeld newspaper to confirm all the above. But by January the nothing was accomplished.
By the time NW gvnt’s chief Director started chairing meetings with various organisations (legal,illegal, known or unknown), including leaders of the protesters, the unemployed alredy gave Lonmin a dealine to comply with their promises. The Chief Director introduced himself, his mission which is the project of building the community.
     He said that  he will be in the community until May/June when proper leadership structures would be in place. He then asked priest to mediate and ward councillors to play oversifght in this project. Councillors became too busy to attend everyday and only three Priests were able to mediate.
    The mistake came when priest started preaching peace in the midst of a revolutionry spirit of the unemployed group and also to meet the group without the Chief Director.This caused emotions to cloud the process and outburst led to conclusion that government does not care.
     I must mention here that the Chief Director promised to support these groups and even go eith them to negotiations and (protest if need be). All they needed was to choose leaders who’ll represent them. As I said, the problem was that priests were talking peace and to the group it meant givi-up on their fight even before confrontation. They refused to give a list of leaders to priests and the rest is history as they say.
     But after I explained this story to those I met o Friday, one of them promised me that if what I said was true, they’ll stop protesting as soon as Monay, the 20th Feb 2012. He is one of the most influenttial people in the group during protests and on the most wanted list of police regarding the current protests. He, however, was not part of the leadership that met with priest at Segwaelane Hall for elections.
      I asked him to be part of leaders as of the said Monday and he agreed. Later police came and arrested some of those protesters, leaving me frustrated there as I tried to stop them from doing so. Police can be useless sometimes; arrests cannot help protesting communities. What police need is a proper training on serving the community. There is no way that communities, that include taxi owners, can allow unemployed people to hold a community ransom.
      There are genuine reasons for people to allow protests to take place and police must learn to establish those reasons and mediate! Bapo Ba Mogale community have been protesting for almost a week, but all police do is come after a lot of vandalism and arrest whoever looks suspicious. For police service to work we no longer need armed reaction, but proactive policing.
Later I established that the guy I wanted to help in the stopping of the protest was able to ellude the police.      

     When I got home I heard more reports of rape as a form of protest.

It is shocking! I want to express my deepest sympathy to rape victims of this protest. It must never happen again, that rape becomes some form of protest. My advice to Bapo Ba Mogale Unemployment Forum is to stop the current protests and continue the project started by the Chief Director of Local Government and Traditional Affairs. The project is waiting and the protest simply extends its delay.

3000 mineworkers gather at Implats: chase off, terrorise 100 black-African shopkeepers:
Rustenburg, Impala Platinum Mine, Lonmin: – Nearly 100 foreign business owners have been displaced after their shops were looted and vandalised during a strike at the Impala mine in Phokeng, North West police said on Sunday.
“Approximately 32 shops were looted, belonging mostly to foreign nationals in close proximity to Freemanville, close to Impala mine,” said police spokesperson Brigadier Thulani Ngubane.”The owners are now staying with friends and relatives in Ziniaville, Rustenburg,” he said. Ngubane said not all business owners who had been affected had opened cases.He said the situation at the Impala mine and Freedom Park was that all local businesses belonging to foreigners in Freedom Park were looted on Thursday and Friday, said Ngubane.

“NO THIS IS NOT XENOPHOBIA”–  BUT ONLY FOREIGNERS WERE ATTACKED:
He denied that the attacks were xenophobic, and he copied the propaganda-claims by the strikers, saying that ‘ the violence had been targeted at businesses, rather than the foreigners who have a monopoly on shops in the area.”
On Saturday, the National Union of Mineworkers (NUM) urged strikers to return to work. Implats has already agreed to re-employ 17,200 workers who were dismissed for striking illegally.

2012-02-19 Black students rioted last week at the Westville University campus in KwaZulu, assaulting students and lecturers, rampaging through campus and destroying property. In addition, one black student who called himself by two names – namely Siyanda Myende and Shle Shlobo – wrote on the campus’ facebook page this past Wednesday:

“Indians will never understand black people because there are too many racial differences.We are born to kill and tomorrow we will wipe out all the Indians on campus. Don’t show up because you will go straight to heaven.’

“For whites we have already started with T.Blanch so we are continuing from there tomorrow this is our country we don’t need whites and Indians at UKZN’.

KZN students reacted in anger at the blatant hate speech – and in response to the outrage the University says they will  investigate this and a case has been alledly been opened against the student. The threats to kill Indians and Whites were amongst the many black-racist attacks and hatespeech targetting lecturers and students at the Westville University campus in last week’s rioting and ‘strikes’.  

 
A second posting by the student, who wrote under the name Siyanda Myende and then changed the name to Shle Shlobo, also posted an apology saying: “I was wrong, I am sorry for that, human error. I will be quit until the sun set.”

The inciteful words were condemned by other students, most of them Indians -  who commented on the facebook page in response:
Nazareen Ebrahim wrote: Siyanda, why are you making these horrible horrible comments and inciting hate in people? This is not why people are using this forum to chat.  There is no place for racism anywhere int heworld and people who express such terrible sentiments will not win.”Kuvesan Krishanthan Naicker wrote: Apologising isn’t gonna do it man, you really don’t know how many people have ween what you’ve said and how its angered them, myself included. I’m sorry, you have no sympathy or respect from me. “

Another posting by Shle Shlobo read: A case has been opened, I have recieved a call, unfortunately, today it my last day on this earth.”  Yashmikha Govender responded: Are you looking for pity after thratening our lives?! Seriously?!

Shle Shlobo posted again:” who ever commented last night made a racism status, and all started with someone who was brutally confused what the strike was all about c.”

Magan Soobramany replied: “That gives u no right to make the statement you did buddy … I can’t seem to sympathise with u.”
Vikarshan Goobiah had this to say: siyanda, u shall bare the fruits of ur unkind words. such remarks cannot b tolerated and in my opinion us should not b included in any university if thats the way your mind works and thinks. we Indians may [be] the Minority but we have every single right as you do. in the laws eyes we no differnt from any other race group, so your hate speech has only done harm to you and your fellow followers and not to us.

The row erupted  after large black gangs describing themselves as ‘strikers’ destroyed Westville campus property and created a dangerously chaotic situation for lecturers and students when they erupted into anger, claiming to be over the lack of financial aid by the university and the lack of student housing.  The SAPS had to use water-cannon, teargas and rubber bullets after students were assaulted and intimidated and a lecturer injured during an assault.

LookLocal writes: “On Tuesday 14 February four students were arrested for public order disturbance and malicious damage to property (MI2P). Three were released because of a lack of evidence and one that is being held in custody is not a UKZN registered student.  On the evening of Tuesday 14 February, students stoned the RMS building and the front glass doors and windows of the main admin block. The Westville SRC president, Lucky Nkalanga, was arrested on an assault charge that was reported earlier in the week.
“During the past two days, we have been dealing with severe racist remarks posted on our face book wall. The University has concluded the investigation into this and is finalising the charges. The individual that started this verbal attack is not a UKZN student,” said Mbadi. “We are also extremely disappointed at the level of racist comments by our students in response to the posting. We encourage all students to embrace the diversity of cultures in our rainbow nation and promote tolerance and mutual respect as articulated in the UKZN PACT. The University is committed to the principles enshrined in our Constitution, notably non-racialism and non-sexism. The University’s Transformation Charter serves as a reminder to all staff and students to contribute to a socially cohesive institutional culture,” added Mbadi. Executive management said they “regret the inconvenience, and in some instances pain and suffering experienced by some staff and students that did not participate in the protest action.”

“At no point did we close our doors to the Wesville SRC. During the protest action, the president of the Westville SRC refused to attend a meeting with the executive director student services that led to the rest of the SRC refusing to engage. In an attempt to avert a protest we have held several meetings with all the SRCs to try and address their issues,” said Madi.

The University is “engaging with government to seek additional funding for financially needy and academically sound students”. Accommodation has been made available for all sponsored students, provided that they provide an original copy of a letter from the sponsor or an affidavit from a parent or guardian. “Every attempt will be made to catch up on lost time,” concluded Mbadi.

The university spokeswoman also claims they will ‘investigate’ the racist hatespeech-matter. “We will use our internal punishment system to investigate this’, she said.

In February 2012, the ANC leaders claimed – inaccurately – that 80% of all the land still belongs to ‘the whites’.

However – according to a March 2011 land-registry survey summary to parliament, the SA State already owned 64,976 of the 85,000 (+) ‘white’ commercial farms and 5,448 agri-holdings registered as ‘white ówned” in 1994 – but the ANC-regime doesn’t know the exact extent of its own state-land holdings because its Land Registry Records do not include the 41% of the total SA land surface of 1,214,470 sq km which used to be the independent tribal homelands – where millions of black people still farm and have settlements today. All this tribal land now is also owned by the State although not lodged in any land-registries…

90% of all the ‘redistributed farms’ are idle:

Below: In March 31 2011, a total 1,155,508 Land parcels were identified as State land – of which 1,085,084 were urban, 64,976 were state-owned farms and 5,448 were state-owned agricultural holdings.  In addition 41% of the SA land-surface were former black homelands: now also owned by the State and occupied/farmed by millions of black people.

Above — Up to 41 % of all the SA land (private and state) was however also identified as being in the formerly independent black homelands – and which parcels could not be reconciled with the SA Deeds Registration System because this land was under the hegemony of autonomic black-tribal entities and was not registered in the SA Deeds office before 1994. After 1994, the homelands ceased to exist. However — Millions of  black South Africans still maintain subsistence farms and settlements there  in e.g. Gazankulu, Bophuthatswana, QwaQwa, Bantu trusts, Kwa-Zulu, Transkei, Venda etc.

Arable farm-land in South Africa occupied only 6% percent of entire land-surface proven to be suitable for renewable, irrigated  food-cropping:

In 1994, the SA revenue registers showed that there were between 85,000 and 100,00 privately-owned, food-producing farms in South Africa, which employed more than 1,6-million workers – all taxpayers who lived on the farms with their families. These farms ever only produced this excess-food on less than SIX PERCENT of the entire surface of the country – although according to the CIA, 12,1 percent of SA is considered ‘arable’ land.

The effect on the SA agricultural sector

Only 1,000 grain-producing commercial farmers by 2010: Grain-SA

By 2010, the Grain-SA Cooperative reported a membership of only 1,000 grain-producing farmers in the entire country. The rest of the members in the Transvaal Agricultural Union and Agri-SA produce many other food-crops and products from livestock – while many commercial farmers also generated extra income by turning to the lower-overhead wildlife-farming and game-lodge tourism and hunting industry.

However what this careful survey of the disreputable records in the SA Deeds Registration Office did reveal, was that there’s considerably more land owned by the State than they realise: that from the original 85,000 privately-owned food-producing farms in the hands of ‘white’ owners -  (“Boer farms”) , only about 14,000 farms and smallholdings in 2010 were registered at the SA Revenue Office as being  revenue-producing ‘white-owned commercial agricultural sites’- all the other farms are in the hands of the State, including of course all the former homelands, municipalities, huge parcels of unused military land, etc.

South Africa is a very arid country with irregular supplies of running surface-water in many regions. Tthe Chief Surveyor-General of the Department of Rural Development and Land Reform urged parliament in their preliminary land-registry analysis on 31 March 2011 that “the many discrepancies discovered in the land-ownership of specific land-parcels be urgently investigated and corrected”.

Mrs Vivien Tillet, 90, above who was brutally assaulted by two black gunmen with fighting sticks on the family farm in northern Zululand on Thurs. Feb 9 2011, was so weakened by the attack that she passed away in November 2011. The fact was only recorded in a formal communication February 12 2012.
Her grandson Keith Lewis – who put up a fierce fight to protect his grandmother from the rape-threat issued by the attackers – sent an email today saying that after she was so badly injured, she needed a hip replacement shortly afterwards. “She was bed-bound thereafter, but was so weakened by her injuries that she passed away in November 2011. The frail old Mrs Tillett was dragged from her bed and into the backyard by her two large, young male Zulu-attackers; beaten over the head; had her ribs broken and an arm sprained. She was lying helplessly in a puddle of blood in the dark, waiting for her family to return. After the assault, she needed a hip-replacement: but she was too weakened to survive and passed away in November 2011.Zululand Observer journalist Cenessa Stork noted at the time that grandson Keith had fought back like a lion to try and protect his frail gran from the two attackers. “The men, armed with a gun and fighting sticks, had broken their locked gate, entered the house and attacked the young Keith with sticks. He also was shot at: the bullet grazed his face. Knowing his fragile grandmother was in her room, Keith fought back with everything he had.”
Threat to rape his gran: One of the Zulu men hissed at Lewis that they were going to rape his grandmother and then kill her. He then tried to lead the men away from his grandmother by staging an escape, hoping the two men would follow him and leave his grandmother alone. He ran outside up the dirt road towards town and waved down a police vehicle. Horror awaited father and son as they got home. Lewis Snr’s elderly mother had been dragged from her bed into the backyard. Beaten over the head, ribs broken and arm sprained, Tillett was lying helplessly in a puddle of blood in the dark, waiting in agony for her family to return.The attackers were nowhere to be found. Mr Allen Hepburn, a resident of the Klipeiland Agricultural Holdings near Bronkhorstpruit, was brutally murdered at his house on Sunday morning while changig a flat tyre on his vehicle in front of his house.

Mr Hepburn (born 24 May 1960), was stabbed 7 times and was found by his wife Marietjie, upon her return. Nothing seems to have been stolen. The extremely high level of violence used against Mr Hepburn indicates that this was no ‘ botched vehicle theft attempt.’ Another attack which will not feature on the Police’s farm attack statistics, since they do not recognise smallholdings as being part of the farming community. January 24 2012 SA Pres Jacob Zuma has come under fire for flouting constitutional requirements over the deployment of the military in civilian areas.Letters sent by the Presidency to Speaker Max Sisulu informing Parliament about three major deployments last year authorised by Zuma showed that they were sent between three and six weeks after their respective deployments had commenced.

The constitution requires that only the president can authorise the deployment of the military, and also that Parliament must be informed “promptly and in appropriate detail” by the president about the deployment. Opposition Party Democratic Alliance wrote to Sisulu requesting him to act against Zuma for “repeated failure to respect Parliament’s standing in relation to defence force deployments”. DA MP David Maynier said letters from Zuma tabled in Parliament yesterday showed how constitutional provisions were violated during the deployments as Zuma “failed to inform Parliament about the details of deployments”.

A black man claiming he was a security official tapped on the window of their car and told them they were not allowed to be there. However before they could flee, two more black males showed up, bashing in the car-window with bricks, and beating the husband in the face while he was trying frantically to drive away. The man’s face was injured by the glass – and when the old car ‘s engine failed and he tried to push the car with his wife steering, the terrified couple were attacked. Three men raped the woman. January 2012 – a murderous month for Afrikaners: “Thus far in January 2012, a total of 17 Afrikaner people were murdered – of whom at least six on farms,” he said. “The Afrikaners are calling on the world to help stop the genocide, the farm murders, in South Africa. Private-land ownership in SA stood at only 33% of the agricultural land in 2001 – yet ANC leaders constantly scream that ‘whites own 80% of all the land’ …

Thus far in January 2012, a total of 17 Afrikaner people were murdered without any apparent motives – of whom at least six, probably more on farms — and Afrikaners are only 3-million people in a population of 50-million South Africans… where the daily murder rate countrywide is 43…

Writes Meersman: “What they are referring to is the proposed Intelligence General Laws Amendment Bill . This is the latest assault by the executive through the legislature on the democratic freedom of all South Africans, rich and poor. Alarmist? Maybe. But one should make no apology for asking a few hard questions when dealing with proposals that affect our fundamental rights.

Surveillance of interception of internet communications without a warrant:

For now let’s dub it the “Stasi Bill”, because it brings into existence an organisation with the same name as the one that existed in East Germany, and it legalises broad powers of interception and surveillance of our telephone conversations, email, and internet communications without a warrant.

The Stasi Bill will bring the Secret Service, National Intelligence Agency, the Office of Interception Services among several others – under one Big Brother bureau. In 2009, this single department, the State Security Agency, was established by Presidential Proclamation (probably unlawfully).

As I wrote here a month ago, it is damaging that the debate around the Secrecy Bill has become couched in the public mind as a battle between the media and a majority government. It is much more than that. The Secrecy Bill and the Stasi Bill form part of the same revision process ordered by the president and pushed by the intelligence community.

The express purpose of the Secrecy Bill is to make for iron-clad classification of the activities of the State Security Agency. Together they will create a security state within the state.

Jacob Zuma and his closest confidants have been spooks in one guise or another…

These development need to be seen in context. Jacob Zuma was for years head of intelligence in the ANC. We must assume he knows what he wants out of this process. His closest confidants have been spooks in one guise or another: Mac Maharaj, Moe Shaik et al.

Zuma has been the target of attempts to abuse the intelligence services for political gain (the infamous Browse Mole Report, the hoax emails, the Zuma spy tapes, Billy Masethle’s firing etcetera).
Subsequently, Zuma himself has been accused (by Athol Trollip of the DA) of using the intelligence services for political surveillance.

The man running the Stasi-Operation in SA will be in charge of the entire security establishment…

“Our security establishment is certainly populated with colourful and shady figures. In 2003 there was the so-called sensational “Bheki Jacobs” dossier (it led to his arrest). That dossier would have had us believe ‘Operation Vula’ was still going; that Mbeki would be deposed and replaced with Jacob Zuma and his co-conspirator Mac Maharaj. Clearly, as time has shown, this was nonsense.”

“Conflicts within the intelligence services arising from different political agendas are therefore an irrefutable reality. Amalgamation will not solve that problem; all it means is there is to be just one agenda, and the man in charge will set that agenda.

After the horror show of apartheid our state intelligence community was “reformed”. But recidivism among spooks is high. Do our intelligence operatives finally embrace the spirit of the Constitution? Has our President for that matter – with his very different intelligence roots – embraced it?
Both the apartheid securocrats and the intelligence agents of the liberation movement operated in a highly secretive ethos — very different from the democratic intelligence service we now wish to establish.

Senior politicians have this nasty habit of seeing ‘bloody agents’ and ‘foreign spies’ among civil society:

“It is discouraging then when senior politicians have this nasty habit of make-believe, seeing “bloody agents” and “foreign spies” among civil society; while our officials are two-thirds of the time unable to tell State from Party. The ruling party would do well to humbly remind itself of its many intelligence failures historically, and its overzealous internal security department that still has things to answer for.

What will stop operatives interpreting their mandate as they see fit? When accountability is so low in almost every government department, how can we be assured state security will be an exception?

Times have definitely changed. Our Ministry of State Security no longer exists to strike fear into the hearts of the public. It even has a Facebook page (‘Liked’ by only 50 people) and a Twitter account (you can follow their rather wry interactions with Maynier).

What is the threat?

This is to be encouraged. A new democratic culture of intelligence has still to take root. But the Stasi and Secrecy Bills could strangle that process.That our intelligence service has in the past decade leaked like a sieve and is not widely considered to be very effective is a real concern if we accept that our national security is under threat.

But what is the threat? Is it Tibetan separatists? Industrial spy rings? Crime syndicates? The Landless People’s Movement? Political dissent? Or is it – to use that dreadfully vague, ideologically loaded word from our past and the USA’s present (which in my view we should not have imported into our legislation) – “terrorists”?

• You would know if NIP, the list of National Intelligence Priorities approved annually by Cabinet, wasn’t classified.

In a living democracy each and every secret should be robustly justified. Are we instead setting off down the same road of current international bad practice that we witness happening in Western democracies around the world? Why should we think South African securocrats would behave any less badly given such laws?

WE the People were not invited to the opening of our parliament – even pedestrians were banned…there were even snipers on the roofs…

That our state security is on a roll was in evidence this week at the arrangements around the State of the Nation address in parliament. Even pedestrians were banned. We the people were not invited to the opening of our parliament.

Prince Buthelezi, in one of his clearer moments, complained that the “extreme”, “unnecessarily tight security measures” was proof enough that “the securocrats have taken over”. There were even snipers on the roofs.  Such is the nature of any security bureaucracy once set in motion; it develops a life of its own, ever more perfected, increasingly impregnable and secret.

As its methods are refined and its abilities become more exhaustive, it transforms into something quite different from what was initially envisaged.

As perceived or actual enemies are uncovered, it expands its definition of what constitutes a threat. Success breeds suspicion. In the end, comes a mindless tyranny over which even its creators lose control – Vlakplaas, Guatanamo Bay, the Stasi.

Far-fetched? We have already deported at least one individual to extraordinary rendition. Do our agencies see international co-operation as more important than protecting our constitutional rights?

Paranoid? Of course, but I’d be less paranoid if I knew this legislation was more tightly drafted in line with the Johannesburg Principles and the 2008 Ministerial Review Commission on Intelligence (for openers); if I knew it was free of executive agendas.

We must hope our Constitutional Court will help us find the balance between democracy and secrecy. But there is enough here to unsettle one, not least the slippage between law and practice.

“When it comes to the activities of a secret police, as with the classification of state information, society needs to be extremely vigilant and everything that can be done to counter potential abuse now or in a future dispensation should be done.”

Feb 14 2012 — Bedfordview journalist Dylan Slater noted this month that the SA Police Service has trouble identifying ‘bogus’ criminals from real police officers; that spokespeople were publishing contradictory statements. Slater thus is unclear on whether two men arrested as ‘bogus cops’ earlier this month, were actually ‘real SAPS members’ or not… because the police also do not seem able to tell…

Unsurprisingly,  ‘bogus’ police syndicates are doing a roaring trade, two Bedfordview journalists including Slater,  found in their in-depth investigation.

Slater wrote on 3 Feb 2012 that initially, he was told by SAPS constable Sharon Mahamba of the Sebenza police station that:

• ‘SAPS Student Constable Vill Seshweni and Warrant Officer Joseph Moabela were patrolling in Modderfontein when they noticed a person handcuffed in the back of a vehicle and two men standing outside the vehicle.  There was a second vehicle on the scene. The two men told the police officers that they were members of the SAPS and were questioning the man. It was established that one man was a police officer from the SAPS Johannesburg cluster.”

Slater: “This contradicted what Lt Col Ndou told Looklocal this afternoon by Lt.Col Ndou, who said:

“It must be mentioned that none of the arrested  suspects are police officers. The other suspect claimed to be a captain in the SAPS, but it was established that he has never been a member of SAPS,” then said warrant-officer Cobus Holloway, also of the Sebenza SAPS, who added:

– “Fingerprints were lifted off both vehicles and a weapon found on the scene of the arrest. This linked both men to four other crimes which have been reported to the SAPS. The one car was reported as hijacked in Dobsonville and the other was also a hijacked vehicle traced back to a case in Pretoria,”–  then said Constable Sharon Mahamba from Sebenza SAPS:  “Both licence discs on the vehicles were fraudulent…”

Two bogus? police men appear Thursday Feb 16 in Kempton Park Magistrate’s Court:

Lt Col Ndou said that the two suspects were still in custody and will appear in Kempton Park Magistrate ’s Court on Thursday February 16 for formal bail application.   “The two suspects are facing charges of possession of unlicensed firearm and ammunition, possession of suspected stolen motor vehicles, impersonating a police officer and possession of police equipment,” said Lt Col Ndou.
